PURHEART, LLC – Website Terms of Use

Please review these Terms of Use (“Terms”) carefully. Access to and use of the PurHeart Industries, LP (“PurHeart,” “we,” “us,” or “our”) website, including any linked sites or applications (collectively, the “Sites”), is subject to these Terms. By accessing or using the Sites, you acknowledge that you have read, understood, and agree to be bound by these Terms.
These Sites are intended primarily for a United States B2B audience. If you access the Sites from outside the U.S., you may encounter information about products or services that are not authorized or available in your jurisdiction.
PurHeart is a contract manufacturer and original equipment manufacturer (OEM) of patented medical device gel packs with U.S. patents granted and international patents pending. We do not offer private labeling; all products are manufactured and branded exclusively by PurHeart.
Nature of Information on the Website
The Sites are provided for informational purposes only. Content on the Sites is not intended as medical advice and does not replace consultation with a licensed health care professional. Users should consult their physician, pharmacist, or other qualified health care provider regarding the suitability of any PurHeart product for their business or end-use applications.
Agreement and Scope
These Terms constitute a legally binding agreement between PurHeart and you, the individual or entity accessing or using the Sites. If you are assisting another person or entity in accessing the Sites, these Terms apply to both the helper and the person or entity being assisted.
By using the Sites, you also agree to the most current version of PurHeart’s Privacy Policy, which governs our collection, use, and disclosure of Personal Data. PurHeart may update these Terms at any time by posting a revised version on the Sites. Your continued use constitutes acceptance of the updated Terms.
You acknowledge that PurHeart may monitor activity on the Sites and may use the results of such monitoring, subject to applicable law.

PurHeart’s Privacy Policies describe how we collect, process, and protect personal data in connection with your use of the Sites and B2B interactions. All use of personal data is governed by applicable law and the Privacy Policy.

- Interfere with the normal operation of the Sites.
License and Intellectual Property
PurHeart grants you a limited, revocable, non-exclusive, non-transferable license to view the content on the Sites for B2B informational purposes only. All rights, titles, and interest in the Sites, including intellectual property such as copyrights, trademarks, patents, and trade secrets, remain with PurHeart and its licensors.
All feedback, suggestions, or other communications provided to PurHeart (“Feedback”) are considered non-confidential and non-proprietary, and you grant PurHeart a perpetual, worldwide, royalty-free license to use, modify, and distribute such Feedback.
Certain trademarks or logos displayed on the Sites belong to third-party licensors and are used under agreement.
Your license terminates immediately if you breach these Terms. Upon termination, you must cease use of the Sites and destroy any copies of content in your possession.
Third-Party Links
The Sites may include links to third-party websites. PurHeart does not endorse or control these websites and is not responsible for their content or any transactions you conduct with third parties. You are responsible for reviewing the terms and privacy policies of any linked websites.
Access and Use of Information
Access to the Sites is limited to legitimate B2B purposes, such as evaluating PurHeart products or services. Any attempt to access restricted areas of the Sites or other PurHeart systems is prohibited.
Product cross-references on the Sites do not guarantee availability or exact functional equivalency. Users should review specifications before making purchasing decisions.
Trademarks and Copyright
All PurHeart and third-party trademarks, service marks, patents, and copyrighted content are protected intellectual property. Use of the Sites does not grant any rights to copy, reproduce, or distribute content beyond the limited license granted herein.
Submissions
Any information, ideas, or materials submitted through the Sites become the exclusive property of PurHeart, unless otherwise agreed in writing. PurHeart has no obligation to maintain submissions as confidential and may use them without compensation.

You represent and warrant that you will not offer or pay anything of value to government employees in connection with purchasing or reselling PurHeart products.
Governing Law and Limitations
These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules. Any legal action must be filed within one year of the event, giving rise to the claim. The Uniform Commercial Code (California) governs transactions, and the United Nations Convention on Contracts for the International Sale of Goods does not apply.
Dispute Resolution
PurHeart may seek legal remedies for nonpayment or other breaches through courts of competent jurisdiction. At PurHeart’s option, disputes may also be resolved through binding arbitration in San Francisco, California, USA, under the American Arbitration Association rules, incorporating UNCITRAL rules where applicable.
